9th CIRCUIT COURT OF APPEAL QUIETLY CRIMINALIZES “BELIEF” IN 2nd AMENDMENT
In a 6 page ruling handed down in the landmark case, U.S. v. Schaeffer Cox, the 9th Circuit Court of Appeals announced the creation of a new principle of law that criminalizes “belief” in the original meaning of the 2nd Amendment.
Prosecuting Attorney, Steven Skrocki, argued that those who believe in the 2nd Amendment as a last ditch defense against government tyranny are effectively “conspiring to murder Federal officials someday.”
Defense attorneys disagreed, pointing to the testimony of the government’s star witness, Mike Anderson, who testified there was “no plan to do anything, only generalized discussion about if there ever was stalinesque martial law, mass arrests, purges of various groups, and stuff like that, it would be better to do as Alexander Solzhenitsyn suggested in his book Gulag Archipelago, and fight back to survive.”
“This abstract belief,” argued Schaeffer Cox’s attorney, “created no real danger to Federal officials, and was so remote and attenuated that the Federal government could not meet the threshold requirements for jurisdiction to even prosecute the case.”
But the 9th Circuit sided with the prosecution, holding that the defendant’s subjective belief that “stalinesque martial law” was likely to someday occur, and that they would then resist, was sufficient to uphold their convictions for conspiracy to murder Federal officials, which carries up to life in prison.
The ruling comes as a shock to many, including Schaeffer Cox, who has been held in an experimental prison for political prisoners since his arrest. “Even the prosecutor agrees that I never actually did anything” writes Schaeffer Cox from prison. “The only way to defend yourself against these kinds of charges is to renounce your belief in The Bill of Rights, and swear your unconditional loyalty to the Deep State Machinery. If I’d done that, I wouldn’t be in prison right now. But I’d feel like I’d have betrayed my country and myself. This really is George Orwell’s Thought Police from ‘1984’.
